ROAD WEIGHT LIMITATIONS AND TRUCK ROUTES:

Section 6.1.4

ROAD WEIGHT LIMITATIONS AND TRUCK ROUTES:

1.
Definitions: The following words and phrases used in this section shall have the following meanings unless a different meaning clearly appears from the context:

AUTHORIZED EMERGENCY VEHICLE: Vehicles of a fire department, police vehicles and such ambulances and public owned or private owned vehicles as are designated by the commissioner of public safety.

COMBUSTIBLE LIQUID: A liquid not meeting the definition of any other hazardous materials class having a flashpoint of one hundred degrees Fahrenheit (100°F) or more and less than two hundred degrees Fahrenheit (200°F).

CORROSIVE LIQUID: A strong mineral acid or other corrosive fluid which is liable to cause fire when mixed with chemicals or with organic matter.

EMPTY VEHICLE: Vehicles that are not loaded or not containing any product or substance for transport or shipment.

EXPLOSIVES: Any chemical compound or mechanical mixture that is commonly used or intended for the purpose of producing an explosion and which contains any oxidizing and combustive units or other ingredients in such proportions, quantities or packing that an ignition by fire, by friction, by concussion, or by detonation of any part of the compound or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous pressures are capable of producing destructible effects on contiguous objects or of destroying life or limb.

FISSIONABLE MATERIALS: Any material whose nucleus will split into one or more approximate equal parts, when receiving energy from any external source.

FLAMMABLE LIQUID: Any liquid which has a flashpoint of one hundred degrees Fahrenheit (100°F) or less, as determined by the Tagliabue or equivalent closed cup device.

GARBAGE TRUCK: A motor vehicle designed, used or maintained primarily for the removal of trash and refuse from residential and commercial properties.

REGISTERED WEIGHT: The registered weight of a vehicle.

SCHOOL BUS: A motor vehicle with motive power designed to carry ten (10) or more passengers which at any time could be used exclusively to transport school children and students to and from school; provided that such transportation service is sponsored and approved by the local board of education. This definition includes vehicles owned by a public or governmental agency as well as vehicles that only carry school children along with other passengers as part of the operation of a common carrier under the jurisdiction of the ICC or PUC, or those vehicles in informal or intermittent agreements such as sharing of actual gasoline expense or participation in a car pool for the transportation of children to and from school. A ten (10) to sixteen (16) passenger unit shall be known as a type I bus.

VEHICLES: Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks.

Application Of Truck Regulations: This section shall apply to all vehicles having a registered weight in excess of thirty thousand (30,000) pounds and to all vehicles transporting explosive or flammable materials. (Ord. 86-7, 10-28-1986; amd. 2004 Code)

Truck Routes: The following streets are hereby designated as truck routes, and the truck route designations are exclusive. Any large vehicles or trucks as herein defined, driven on any street other than those herein named, or such alternate or temporary routes which may from time to time be designated, is in violation of this chapter, and the driver thereof shall be guilty and subject to penalty provided in section 1-4-1 of this code. Reserved Right: The city has the right to close city roads and to detour traffic whenever necessary.
5.
Exceptions: This section shall not apply:
1.
To authorized emergency vehicles upon any street in the city.
2.
To vehicles upon any officially established detour in any case where such truck could be lawfully operated upon the street for which such detour is established.
3.
To any street in an industrially zoned area of the city.
4.
To trucks delivering merchandise to or from local businesses, local residences, established truck terminals, and maintenance facilities.
5.
To construction trucks delivering to or returning from construction sites where it is not possible to use a designated truck route.
6.
Truck Parking:
1.
Hazardous Materials: It is hereby declared unlawful for any vehicle transporting explosive, corrosive, flammable or combustible liquids to park within three hundred feet (300') of any residential area within the city limits.
2.
Heavy Equipment: The storage and/or continuous on street parking of trucks having a registered weight in excess of thirty thousand (30,000) pounds and construction equipment such as bulldozers, graders, compressors, etc., shall not be permitted in any residential zone; provided, that construction equipment may be stored on a lot during construction of a building thereon, but not to exceed one year.
7.
Information: The city recorder maintains maps. The city recorder shall keep and maintain accurate maps setting forth truck routes and streets upon which truck traffic is permitted. The maps shall be kept on file in the office of the city recorder, and shall be available to the public. (Ord. 86-7, 10-28-1986; amd. 2004 Code)
