The preliminary plat shall be reviewed by the planning commission, which shall act on the plat as submitted within forty five (45) days after its presentation to the commission or, if modified, within forty five (45) days of the presentation of the latest modification. The planning commission shall then either approve or reject the subdivision preliminary plat design. If approved, the planning commission shall express its written approval with whatever conditions are attached and by returning one copy of preliminary plat, signed by the commission chairperson, to the subdivider. If the preliminary plat is disapproved, the planning commission shall indicate its disapproval in writing and reasons therefore by similarly signed copies. Upon the planning commission's approval, the subdivider is authorized to proceed with the preparation of the final plat and detailed construction drawings and specifications for the improvements required in this title.
