Application For Designation: The owner or agent of a tract or parcel of land proposed to be divided into fewer than five (5) building sites, tracts or lots shall apply to the planning commission for designation of the development as a minor subdivision, if such division meets the requirements for a minor subdivision as outlined herein. Such applications shall include a legal description of the tract and of the proposed lots and a location map indicating the relation of the lots to existing roads.

Action On Application:

A preliminary plat shall be required for all subdivisions, but under conditions listed below, approval of the preliminary plat by the planning commission and by the governing body shall be authorization for the subdivider to sell lots within the subdivision covered by the preliminary plat by metes and bounds, and the requirements of a final plat shall be waived. When final plats are not required, the subdivider or landowner shall provide all the required subdivision improvements required for standard subdivisions. All such improvements shall be constructed in accordance with the provisions of this title and as defined by the city engineer. Final plats shall not be required where all the following conditions exist:

The subdivision consists of fewer than five (5) lots.

The subdivision does not require the dedication of any land for street or other public purpose.

The subdivision is not transversed by the mapped lines of a proposed street or a street to be widened, as shown on the master plan or on the official map.

Each of the lots in the subdivision meets the public street frontage width and area requirements of the zoning ordinance, or has been granted a variance from such requirements by the board of adjustment, under powers of the board granted in the zoning ordinance.

The lots are not part of a minor subdivision approved less than three (3) years earlier.

All minor subdivisions are to provide a bond or escrow, which is to be set by the city engineer, and in addition approved by the city council, as with all other subdivisions in the city. All other provisions of the standard subdivision title shall apply to the minor subdivision. (Ord. 86-3, 3-11-1986)
